Fileay DMCA & Copyright Policy
Last Updated: September 19, 2026
Fileay respects the intellectual property rights of creators, copyright owners, publishers, developers, businesses, and other rights holders.
This DMCA & Copyright Policy explains how copyright owners may report allegedly infringing content hosted through Fileay.com, how Fileay may respond to copyright complaints, how users may submit counter-notifications, and how repeated copyright violations may affect Fileay accounts.
This policy should be read together with the Fileay Terms of Use, Acceptable Use Policy, and Privacy Policy.
Copyright-related questions and notices may be sent to:
1. Our Copyright Policy
Fileay provides file-hosting, storage, downloading, and sharing services.
Users are responsible for ensuring that files they upload, store, distribute, or share through Fileay do not infringe the copyrights or other intellectual property rights of third parties.
You may not knowingly use Fileay to upload or distribute copyrighted content without permission from the rights holder when authorization is legally required.
Fileay may remove or restrict access to content when we receive a valid copyright complaint or otherwise determine that content violates our policies.
2. Content Uploaded by Users
Files available through Fileay may be uploaded by independent users.
Fileay does not claim ownership of user-uploaded files merely because they are stored on our platform.
Users retain responsibility for:
- The files they upload
- Their right to distribute those files
- The sharing links they create
- Compliance with copyright law
- Compliance with licensing restrictions
- Compliance with Fileay policies
A file being available through Fileay does not mean that Fileay endorses, owns, licenses, or has independently reviewed that file.
3. Copyrighted Content
Copyright protection may apply to many types of works, including:
- Movies
- Television programs
- Music
- Photographs
- Artwork
- Software
- Video games
- Books
- E-books
- Articles
- Courses
- Training materials
- Source code
- Graphics
- Audio recordings
- Digital products
- Subscription-only content
Copyright owners generally control how their protected works may be reproduced and distributed, subject to applicable exceptions and limitations.
4. Authorized Content
Users may upload copyrighted content when they have the legal right to do so.
Examples may include content:
- Created by the uploader
- Owned by the uploader
- Licensed for distribution
- Released under a suitable open license
- Authorized by the copyright owner
- In the public domain
- Used in a manner permitted by applicable law
Users are responsible for determining whether their use is legally permitted.
5. Reporting Copyright Infringement
If you believe that material available through Fileay infringes your copyright, you may submit a copyright infringement notice.
Please send notices to:
Email: hello@fileay.com
Recommended email subject:

DMCA TAKEDOWN PROCEDURE
6. DMCA Notices
If the Digital Millennium Copyright Act (“DMCA”) applies to Fileay or to the complaint, a copyright owner or authorized representative may submit a notification under applicable U.S. copyright law.
A DMCA notice should contain the information required by applicable law.
Incomplete notices may delay our ability to investigate or act.
7. Information Required in a Copyright Notice
A copyright complaint should generally include:
Identification of the Copyrighted Work
Identify the copyrighted work you believe has been infringed.
If multiple works are involved, you may provide a representative list where legally appropriate.
Identification of the Infringing Material
Provide enough information for Fileay to identify the allegedly infringing material.
Whenever possible, include the exact Fileay URL, for example:
https://fileay.com/...
Descriptions such as “someone uploaded my movie” without a specific URL may not provide enough information to locate the file.
Your Contact Information
Include:
- Full name
- Company or organization, if applicable
- Email address
- Mailing address
- Telephone number, where appropriate
Good-Faith Statement
Include a statement that you have a good-faith belief that the disputed use is not authorized by:
- The copyright owner

Include a statement that the information in your notice is accurate and, under penalty of perjury where applicable, that you are:
- The copyright owner, or
- Authorized to act on behalf of the copyright owner
Signature
Include a physical or electronic signature of the copyright owner or authorized representative.
Typing your legal name at the end of an electronic notice may constitute an electronic signature where legally recognized.
8. Recommended DMCA Notice Format
A notice may use language similar to:
I am the copyright owner, or I am authorized to act on behalf of the copyright owner, of the work identified below.
Copyrighted work: [Describe the work]
Infringing Fileay URL: [Full URL]
I have a good-faith belief that the use described above is not authorized by the copyright owner, its agent, or the law.

Email: [Email]
Address: [Address]
Phone: [Phone]
Signature: [Electronic or physical signature]
Do not intentionally submit false copyright claims.
9. What Fileay May Do After Receiving a Complaint
After receiving a sufficiently complete complaint, Fileay may:
- Review the notice
- Locate the reported material
- Request additional information
- Disable access to the file
- Remove the file
- Notify the uploader
- Record the copyright complaint
- Restrict associated sharing links
- Apply account-level enforcement where appropriate
The exact action taken depends on the circumstances and applicable law.
10. Notification to the Uploader
Where appropriate, Fileay may notify the user who uploaded the reported material.
The notice may include information about:
- The affected file
- The copyright complaint
- The removal or restriction
- Available counter-notification procedures
- Applicable account consequences
We may share limited complaint information with the uploader where necessary to process the dispute and where permitted by law.
COUNTER-NOTIFICATIONS
11. Counter-Notification Rights
If your file was removed or disabled because of a copyright complaint and you believe the removal was caused by mistake or misidentification, you may be able to submit a counter-notification.
Counter-notifications should only be submitted when you genuinely believe you have a lawful basis to challenge the removal.
12. Information Required in a DMCA Counter-Notification
Where the DMCA applies, a counter-notification generally should include:
- Your physical or electronic signature
- Identification of the material that was removed
- The Fileay location where the material appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification
- Your full name

- Your telephone number
- Your email address
- A statement consenting to the jurisdiction required by applicable DMCA procedures
- A statement that you will accept service of process from the person who submitted the original copyright notice or their agent
Counter-notifications may be sent to:

DMCA Counter-Notification – Fileay
13. Recommended Counter-Notification Format
A counter-notification may use language similar to:
I state under penalty of perjury that I have a good-faith belief that the material identified below was removed or disabled as a result of mistake or misidentification.
Removed material: [Description]
Previous Fileay URL: [URL]
Name: [Full legal name]
Address: [Address]
Email: [Email]
Phone: [Phone]I consent to the jurisdiction required under applicable DMCA law and agree to accept service of process from the party who submitted the original copyright notice or their agent.
Signature: [Electronic or physical signature]
Do not submit a counter-notification merely because you disagree with the copyright owner.
14. Forwarding Counter-Notifications
Where applicable, Fileay may forward a valid counter-notification to the party who submitted the original copyright complaint.
The original complainant may then have an opportunity to pursue appropriate legal action.
15. Restoration of Content
Where the DMCA applies, content may become eligible for restoration after the applicable statutory waiting period if:
- A valid counter-notification has been submitted, and
- The original complainant does not notify Fileay of qualifying court action within the applicable period.
Restoration is not guaranteed where:
- The content violates another Fileay policy
- The content is illegal
- The account has been suspended
- Security concerns exist
- Another valid legal basis requires the content to remain unavailable
REPEAT INFRINGERS
16. Repeat Copyright Infringement
Fileay does not permit repeated use of the service for copyright infringement.
Where appropriate, Fileay may restrict or terminate accounts associated with repeated copyright violations.
Factors we may consider include:
- Number of valid copyright complaints
- Nature of the reported content
- Frequency of complaints
- User response to notices
- Evidence of deliberate infringement
- Attempts to evade enforcement
- Creation of additional accounts after suspension
17. Account Enforcement
Copyright violations may result in actions including:
- File removal
- Link disabling
- Warning notices
- Upload restrictions
- Download restrictions
- Suspension of PPD earnings
- Payout holds
- Temporary account suspension
- Permanent account termination
Serious or repeated infringement may lead to stronger enforcement without repeated warnings.
18. Circumventing Copyright Enforcement
Users may not attempt to bypass copyright enforcement by:
- Re-uploading removed material repeatedly
- Renaming infringing files
- Changing file extensions
- Using encrypted archives to conceal infringing content
- Creating additional accounts
- Generating replacement links
- Using technical methods to avoid detection
Such activity may result in account termination.
PAY PER DOWNLOAD AND COPYRIGHT
19. Copyrighted Files and PPD Earnings
Fileay's Pay Per Download system may only be used with content that the uploader has the legal right to distribute.
Users may not knowingly earn money from unauthorized distribution of copyrighted material.
20. Earnings Associated With Infringing Content
Where files are removed because of copyright violations, Fileay may, where permitted by applicable rules and law:
- Stop earnings from the affected file
- Exclude related downloads
- Hold suspicious earnings
- Review the user's account
- Reverse invalid earnings
- Restrict PPD participation
Copyright infringement must not be used as a method of generating Fileay earnings.
21. Fraudulent Copyright Traffic
Users must not deliberately upload popular copyrighted works without authorization merely to attract downloads or increase PPD earnings.
Examples may include unauthorized uploads of:
- Newly released films
- Paid software
- Commercial games
- Subscription content
- Premium courses
- Music releases
- Paid digital products
Such conduct may lead to immediate restrictions.
FAIR USE AND OTHER EXCEPTIONS
22. Fair Use and Lawful Exceptions
Not every use of copyrighted material is necessarily infringement.
Applicable law may recognize exceptions such as:
- Fair use
- Fair dealing
- Quotation
- Commentary
- Criticism
- News reporting
- Education
- Research
- Parody
- Other statutory exceptions
Whether an exception applies depends on the facts and applicable law.
Fileay does not determine complex copyright disputes as a court would.
Users and complainants should obtain legal advice where appropriate.
23. Public Domain Content
Works that are genuinely in the public domain may generally be distributed without copyright authorization.
Users remain responsible for determining whether a work is actually in the public domain in the relevant jurisdiction.
24. Open and Creative Commons Licenses
Fileay may host content distributed under open licenses, including Creative Commons licenses, where the uploader follows the applicable license terms.
Those requirements may include:
- Attribution
- Sharing under the same license
- Non-commercial limitations
- Restrictions on derivative works
Users are responsible for complying with the specific license.
MISREPRESENTATION
25. False Copyright Claims
Copyright reporting systems must not be used to:
- Harass users
- Remove lawful competitors
- Silence criticism
- Target content you do not own
- File deliberately false claims
Submitting materially false copyright notices may create legal liability.
26. False Counter-Notifications
Users must not submit counter-notifications containing knowingly false statements.
A counter-notification is a legal declaration and should be treated seriously.
27. Good-Faith Requirement
Both complainants and users are expected to participate in the copyright process in good faith.
Fileay may restrict use of the reporting system where we identify systematic abuse.
TRADEMARKS AND OTHER RIGHTS
28. Trademark Complaints
This policy primarily addresses copyright.
Trademark complaints may also be submitted to:
Please include:
- The trademark
- Registration details, if applicable
- The reported Fileay URL
- Explanation of the alleged infringement
- Your contact information
- Evidence that you own or represent the trademark owner
29. Other Intellectual Property Rights
Complaints concerning other intellectual property rights may also be reviewed where Fileay has sufficient information and legal grounds to act.
NON-U.S. COPYRIGHT COMPLAINTS
30. International Copyright Complaints
Fileay may receive copyright complaints from rights holders outside the United States.
If the DMCA does not apply, we may still review complaints under:
- Applicable local copyright law
- Fileay's Terms of Use
- Fileay's Acceptable Use Policy
- Other relevant legal requirements
Copyright law differs between countries.
31. International Users
Users are responsible for complying with copyright laws applicable to their activities.
Content legal to use in one jurisdiction may be restricted in another.
REPORT REQUIREMENTS
32. Provide Direct File URLs
When reporting content, provide the specific Fileay file or download URL whenever possible.
Do not submit only:
- Search engine results
- Screenshots without URLs
- Homepage links
- General descriptions of Fileay
- Third-party websites that merely link elsewhere
We need enough information to identify the content hosted through Fileay.
33. Multiple URLs
If your complaint concerns multiple files, list each relevant Fileay URL clearly.
Large notices may be submitted in an organized spreadsheet or document where appropriate.
34. Evidence of Ownership
Fileay may request additional evidence demonstrating that:
- You own the copyrighted work, or
- You are authorized to represent the owner
This may be particularly important where ownership is disputed.
PRIVACY AND COPYRIGHT NOTICES
35. Information Sharing
Information contained in copyright notices and counter-notifications may be shared with:
- The affected uploader
- The complaining party
- Legal advisers
- Authorities where required
- Other parties as necessary to process the complaint
Do not include unnecessary sensitive personal information.
36. Retention of Copyright Records
Fileay may retain copyright complaints, counter-notifications, enforcement records, and related correspondence for purposes including:
- Legal compliance
- Dispute resolution
- Repeat-infringer enforcement
- Fraud prevention
- Abuse prevention
- Defending legal claims
Retention is subject to applicable law and the Fileay Privacy Policy.
DESIGNATED DMCA AGENT
37. Designated Copyright Agent
If Fileay operates under the U.S. DMCA safe-harbor framework, the service should maintain a properly registered designated DMCA agent.
Before publishing this section as final, complete the following information:
Service Provider: Fileay / [Legal operator name]
Designated Agent: [Name or role]
Address: [Physical mailing address]
Telephone: [Telephone number]
Email: hello@fileay.com
If Fileay intends to rely on U.S. DMCA safe-harbor protections, the operator should also ensure that its designated agent information is properly registered and kept current with the U.S. Copyright Office.
38. Do Not Invent Agent Information
Do not publish a false address, company name, telephone number, or designated-agent identity.
These details should correspond to the actual entity legally operating Fileay.
FILEAY ENFORCEMENT
39. Content Removal Does Not Determine Ownership
When Fileay removes content following a copyright notice, that action does not necessarily constitute a final legal determination that infringement occurred.
Fileay is generally responding as a service provider to reported content.
Courts and other competent authorities ultimately resolve contested copyright ownership and infringement disputes.
40. Fileay May Act Independently
Fileay may remove or restrict content even without a formal DMCA notice where we reasonably determine that content:
- Violates the Terms of Use
- Violates the Acceptable Use Policy
- Presents a security risk
- Is clearly unlawful
- Violates other platform rules
41. Fileay May Decline Invalid Requests
Fileay may request clarification or decline to process notices that:
- Do not identify specific content
- Lack required information
- Clearly concern content not hosted by Fileay
- Appear fraudulent
- Are abusive
- Are unrelated to copyright
- Do not provide a reasonable basis for action
42. No Guarantee of Immediate Removal
We aim to review complete copyright reports reasonably promptly.
However, processing time may depend on:
- Number of URLs
- Completeness of the complaint
- Complexity of ownership
- Need for additional information
- Legal requirements
- Volume of reports
Do not assume that sending a notice automatically guarantees immediate removal.
CHANGES TO THIS POLICY
43. Policy Updates
Fileay may update this DMCA & Copyright Policy from time to time.
Updates may be made because of:
- Changes in law
- Changes to Fileay services
- Changes to reporting procedures
- New abuse patterns
- Operational requirements
The Last Updated date at the beginning of this policy may be revised when changes are published.
44. Relationship With Other Fileay Policies
This policy should be read together with:
- Fileay Terms of Use
- Acceptable Use Policy
- Privacy Policy
- PPD Terms
- Payout Policy
- Other applicable Fileay policies
A copyright complaint does not prevent Fileay from taking additional action under another policy where appropriate.
